This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 162 dated 05.09.2014 under Sections 376-D, 342/343/201 IPC and section 6 of Protection of Children from Sexual Offences Act, 2012 at Police Station Model Town, Hoshiarpur. An FIR was registered against the petitioner on statement of Harpreet Kaur. She alleged that she received a call on her mobile number 9592624289 from another mobile number 7273099221. The caller disclosed his name as Raju. On 27.08.2014, complainant had gone to the market. At that time, one of the accused came on a bike and told her that he deliberately made the phone calls on her number. The accused took her to a hotel at Chohal road and forced her to drink liquor. Thereafter, his friends also came there and committed rape turn by turn.

She was kept in hotel room for four days and repeatedly raped. On 01.09.2014, she managed to come out and narrated the whole incident to her parents. As per record, accused could not be arrested during investigation. At the time of presentation of AJAY KUMAR 2015.04.

CRM-M 11338 of 2015 challan, his name was shown in the column of proclaimed offenders. In my considered view, petitioner is not entitled to discretionary relief of pre-arrest bail as allegations against him are serious. No merits. Dismissed.
