Allegations against the petitioner Vinod Kumar in this third application for regular bail under Section 439 Cr.P.C. in case FIR No.96 dated 05.10.2011 registered at Police Station Moonak under Sections 306/34 IPC are that on 05.10.2011 around 5.00 a.m. the accused had been instrumental in the death of Suman wife of the present petitioner who died because of the burn injuries.     Learned counsel representing the petitioner Mr. Manish Kumar Singla, Advocate submits that the petitioner is in custody since more than four years and that the trial has been put to hold in another proceedings before this Court, and prays for grant of bail to the petitioner. However, the same is opposed on behalf of the complainant as well as State on the ground that minor child of the accused and the deceased namely Dhruv Singla has testified by way of ocular version and that if allowed bail the petitioner would influence the witnesses. Appreciating these submissions without feeling the necessity to advert onto the merits of the case, keeping in view the heinousness of the offence and the prima facie case and that the apprehension of the State that if allowed bail the petitioner would influence the witnesses is not uncalled for, impels this Court to dismiss the instant bail application.
