(ORAL) The petitioner herein has sought the relief of anticipatory bail in the criminal case arising out of the FIR bearing No.25 dated 14.02.2021 registered at Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib, under Sections 307, 364, 511, 323, 148 and 149 IPC and Sections 25 and 27 of the Arms Act.

Status-report on behalf of the respondent-State (by way of the affidavit of D.S.P. Sub Division, Sri Muktsar Sahib), as forwarded by learned State counsel to the Court through email, is taken on the record. In para No.6 of the said status-report, it has categorically been deposed that petitioner Nirmal Singh @ Nimma and some of his NEETU RANI 2022.01.11 18:37 I attest to the accuracy of this order PHHC

co-accused were not found to be present at the place of occurrence and therefore, they have been declared innocent and now, the FIR subsists against accused Harmanjit Singh and Charanjit Singh only. Learned State counsel, on the instructions from ASI Ashok Kumar, from the above-said Police Station, confirms the afore-referred facts.

At this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition while submitting that it has become infructuous in view of the above-discussed contents of the statusreport as well as the submission of learned State counsel. Learned State counsel has no objection to the same. Resultantly, the petition in hand stands dismissed for having been withdrawn accordingly.
