RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Ravi @ Gorkha - in case FIR No.485 dated 25.11.2018 registered under Section 148, 149, 307, 323, 427, 452, 506 IPC (Sections 302 IPC added lateron) and Section 25 of the Arms Act, 1959 at Police Station KUK, District Kurukshetra. Learned counsel inter alia contends that petitioner was not named in the FIR. Complainant, his wife and son, who appeared as PW2 to PW4, respectively, did not support the prosecution case. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Co-accused of the petitioner namely, Rahul Malik and another have been granted regular bail by this RAVINDER SINGH 2020.08.06 17:13 I attest to the accuracy and integrity of this document

Therefore, treating the case of the petitioner on the same parity as that of his co-accused, he may also be granted regular bail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Petitioner - Ravi @ Gorkha - is ordered to be released on bail during pendency of trial, if not required in any other case, on the same parity as that of his aforesaid co-accused, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
