Learned counsel for the petitioner argues that the claim of the son of the petitioner for the grant of compassionate appointment has been declined by the respondents vide order dated 15.02.2022 (Annexure P-4) only on the ground that the son of the petitioner was not 10th passed, as, for the appointment to post of peon, a candidate must be a matriculate. Learned counsel for the petitioner submits that the petitioner has attached his matriculation certificate which was issued to him on 11.06.2021 and on the date when the impugned order has been passed, the petitioner already had matriculation certificate and hence, the ground given by the respondents for the rejection of the claim of the petitioner is bad. 3.

Learned State counsel submits that in case, the petitioner thinks that order rejecting the claim of the petitioner has been passed on factual error, let the petitioner file an appropriate representation with the competent authorities bringing out that the impugned order is factually incorrect by attaching all the documents in the support of son of the petitioner and a fresh RIYA 2023.12.02 12:32 I attest to the accuracy and integrity of this document

CWP-4674-2022 (O&M) 2023:PHHC:152453 consideration will be given to the claim of the petitioner without being influenced by the earlier impugned order within a period of eight weeks from the date of receipt of such representation by passing appropriate speaking order.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, at this stage, with liberty to file an appropriate representation with respondents.
