**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.50 dated 07.03.2017 registered under Section 409 IPC at Police Station Navi Baradari, District Jalandhar.

On 09.03.2021, following order was passed by the Coordinate Bench of this Court:- "The matter has been taken up for hearing through video conferencing due to outbreak of COVID-19. Learned counsel for the petitioner submits that the petitioner deals with floor tiles and received cheque from Navdeep Singh, SDO, PWD, Jalandhar, who purchased tiles from the petitioner. The tiles so delivered by the

petitioner were duly utilised and the same find floored in Tehsil Complex, Jalandhar. Now, the petitioner is being framed in the case presumably on the basis of some audit report.

Notice of motion for 19.05.2021.

In the meantime, in the event of arrest of the petitioner, he shall be released on ad-interim bail to the satisfaction of the arresting officer. However, the petitioner shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C.

Learned counsel for the petitioner submits that petitioner deals with floor tiles and received cheque from Navdeep Singh, SDO, PWD, Jalandhar, who purchased tiles from the petitioner. The tiles were delivered by the petitioner which were duly utilized by Navdeep Singh, SDO, PWD in flooring of the Tehsil complex at Jalandhar.

Learned counsel further submits that the petitioner has been implicated solely on the basis of audit report which was subsequently done. While issuing notice of motion, petitioner was directed to join investigation and in compliance of the said order, the petitioner has joined the investigation to the entire satisfaction of the Investigating Officer.

The aforesaid fact has been admitted by learned State counsel on instructions from SI Rajwinder Kaur. Learned State counsel further submits that the petitioner has joined the investigation on 07.03.2021 and is no more required for further investigation of the case. Challan has already been presented

on 30.04.2021.

In view of aforesaid factual position, the interim order dated 09.03.2021 is made absolute. However, the petitioner shall keep on appearing before the trial Court regularly. Petition stands disposed of.
