**** AJAY KUMAR MITTAL, J. (Oral) This order shall dispose of CWP Nos. 4707 and 5389 of 2019, as according to learned counsel for the parties, the issue involved therein is identical. However, the facts are being extracted from CWP No. 4707 of 2019. 2.
In CWP No. 4707 of 2019, the petitioner has approached this Court under Articles 226/227 of the Constitution of India, for issuing direction to the respondents to refund the amount of excess ITC amounting to ` 32,40,040/- assessed by respondent No.5 vide Assessment Order dated 16th October, 2018 (Annexure P-1) and claimed by the petitioner vide Form VAT-29, dated 3.11.2018 (Annexure P-2) along with interest @ 12% p.a. 3.
Learned counsel for the parties are ad idem that during the pendency of the writ petition(s), necessary relief has been granted to the petitioner(s). Accordingly, it was prayed that the present writ petition(s) has been rendered infructuous and may be disposed of as such.
