The petitioners through instant petition under Articles 226 and 227 of the Constitution of India are seeking setting aside of order dated 02.08.2018 (Annexure P-5) whereby respondent has kept their claim in abeyance. They are further seeking direction to respondent to fill up the post of Tutors by promoting them in compliance of directions of Central Administrative Tribunal, Chandigarh Bench. 2.

Learned counsel for respondents No.1, 3 and 4 submits that petitioners have effective and efficacious alternative remedy, thus, writ petition should not be entertained.

Faced with this, learned counsel for the petitioners submits that present petition may be transferred to Central Administrative Tribunal, Chandigarh (for short 'Tribunal').

Learned counsel for respondents No.1, 3 and 4 does not oppose the aforesaid prayer.

Keeping in mind that writ petition is pending before this Court since 2021 and there is no objection to respondent if petition as such is transferred to learned Tribunal, the Registry is hereby directed to forward paper book to learned Tribunal. The parties at the first instance would appear before learned Tribunal on 18.05.2026 and thereafter as directed by learned Tribunal.
