Mr.Kirat Singh Sidhu,DAG Punjab assisted by HC Major Singh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail in case FIR No.1 dated 3.1.2014 under Section 61 of the Punjab Excise Act,1914, PS Nakodar,Distt.Jalandhar.

Petitioner was apprehended at the spot and found distilling illicit liquor. There is recovery of 15 bottles of 750 milliliters each and another bottle containing 570 milliliters of distilled illicit liquor from petitioner.

He was enlarged on bail on 23.1.2014 and he left for UAE on 1.3.2015 to join his employment as a Carpenter. On returning back on 6.2.2016 he came to know that he has been declared a PO on 9.9.2015.

CRM-M 12498/2016 appearance at the time of presentation of challan on 20.1.2015. However, it is conceded that petitioner had violated the terms of grant of bail. Present petition is in the nature of mercy petition. Vide order dated 26.4.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 7 days, petitioner be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioner surrendered before the trial court on 2.5.2016 and was released on interim bail. Learned State counsel on instructions is unable to refute the said factual position.

In view of the above interim bail granted by the trial court, pursuant to the order dated 26.4.2016, is made absolute. Disposed of.
