Main case.

It is contended that petitioner No.1 - Tarun Kumar, aged about 19 years has got married with petitioner No.2- Mohini Sharma, aged about 17 years, against the wishes of family members of Banita Chugh 2018.04.03 16:44 I am the author of this document

CRM-M No. 12448 of 2018 -2petitioner No.2, arrayed as private respondents No. 4 to 8, who are threatening to interfere in their marital life, as such to seek protection in that regard, the petitioners have approached this Court by way of filing the present petition.

Obviously this marriage is not in accordance with requirement of Section 5 of the Hindu Marriage Act. However, no physical harm to the petitioners can be allowed to be caused. The petition is disposed of with a direction to respondent No.2 - the Commissioner of Police, Ludhiana, to ensure that no physical harm is caused to the petitioners at the hands of respondents No. 4 to 8 or persons claiming under them.

However, this order shall not validate the marriage between the petitioners and shall not have any effect on any civil or criminal action to which the petitioners may be found liable, under the law.
