(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 85 dated 12.03.2017, registered at Police Station Farakpur , Distt. Yamuna Nagar, who has been booked for having committed the offence punishable under Section 354(A) (i) IPC and Section 3 (i)(xi) of S.C and S.T (Prevention of Atrocities Act). Learned counsel submits that the present petitioner, his wife and the complainant are working in the same school. Further the complainant with the help of police had wrongly got planted S.C/S.T Act, as the complainant does not belong to Balmiki and her parents had converted religion to Christianity for gainful purpose.
Learned counsel further submits that petitioner was also beaten up on the same day in the school premises and on representation by wife of the petitioner, F.I.R No. 87 dated 14.03.2017 has been registered and as per C.C.T.V footage (Annexure P-3), it shows the beating of the GAURAV ARORA 2017.04.
Crl. Misc. No. M-11612 of 2017 -2petitioner. Learned State counsel on instruction from Investigating Officer states that challan has not been presented till date. Heard.
Petitioner is in custody since 13.03.2017 Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Yamuna Nagar.
