The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.100 dated 24.6.2018 registered for the offences under Sections 201, 302 and 34 IPC Police Station Sohna, District Gurugram.

Notice of motion was issued in this case.

Mr. Navdeep Singh, learned Assistant Advocate General, Haryana has appeared on behalf of the respondent-State and Mr. Abhimanyu, Advocate has appeared on behalf of the complainant and contested this petition.

Cr. Misc. No.M-9225 of 2019 [2] I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. The present petitioner is named in the FIR. As per the allegations in the present case Rajinder alias Raje proceeded from the house on 23.6.2018 in the morning at around 9.00 hours and thereafter, he consumed liquor on the tube-well of Kalu-Sarpanch along with Sonu, Rajesh etc. In the evening, the complainant was informed that his brother is lying in the drain, who had sustained serious injuries. Raje died due to the injuries.

The learned State counsel argued that in the present case blood stained iron rod as well as blood stained clothes were recovered from the petitioner and the human blood was found on the clothes and iron rod. Keeping in view the nature and gravity of the offences and the fact that the case is at preliminary stage, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in this petition, the same is dismissed.
