* * * * A. B. CHAUDHARI, J. (ORAL) The petitioner has filed the present petition under Section 439 Cr.P.C. seeking regular bail in FIR No.94 dated 26.07.2016 registered under Section 20-B NDPS Act, 1985 at Police Station Faridabad, District GRP Ambala Cantt.
Heard learned counsel for the rival parties.
In the aforesaid FIR the petitioner was arrested on 26.07.2016 and since then he is in jail. Challan has been filed in this case and no other case is reported against the petitioner and the quantity of the ganja was 13.5 kilograms, which is not commercial quantity. The trial is going on which will take its own time for disposal.
In that view of the matter, I am inclined to grant bail to the petitioner. Accordingly the petition is allowed. Bail to the satisfaction of the concerned CJM/Duty Magistrate. 6th February, 2017 'raj'
