IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM No.M-11626 of 2017 Date of decision: 18.04.2017 Rajwinder Kaur ....Petitioner

Versus

State of Haryana and others ....Respondents CORAM: HON'BLE MRS. JUSTICE REKHA MITTAL

Present:

Ms. Loveleen S. Dhaliwal, Advocate for the petitioner.

REKHA MITTAL J. (Oral) By invoking Section 482 of the Code of Criminal Procedure (in short 'Cr.P.C.'), the complainant (mother of the alleged victim) has prayed for issuance of directions to the trial Court to decide the application filed under Section 311 Cr.P.C. expeditiously. On a pointed query raised by the Court as to whether the complainant could maintain such an application without intervention of the prosecuting agency, counsel has informed that as per her understanding, the application could be filed through prosecuting agency even though, there is no bar created under Section 311 Cr.P.C. It has further been submitted that even this issue is to be decided by the Court below after getting response from the other side. Keeping in view the limited prayer made by the petitioner, the present petition is disposed of with a direction to the trial Court to decide the application filed under Section 311 Cr.P.C. within a period of 15 days from the date of receipt of certified copy of the order.
