**** AJAY TEWARI, J.(Oral) Learned counsel for the appellant states that there were three similar appeals against the common judgment and two of them appeals bearing Nos. FAO No. 2376 and 2377 of 1994 have been decided by judgment and order dated 4.12.2012.

In the circumstances, the matter is disposed of in the same terms as in FAO No. 2376 and 2377 of 1994. Ordered accordingly. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
