CRM-M-12617-2016 Present petition for release of petitioner on regular bail in FIR No.8 dated 16.01.2016, under Sections 363 and 366 IPC and Section 6 of POSCO Act, registered at Police Station Sarangpur, U.T. Chandigarh. Learned counsel for the petitioner submitted that the statement of the prosecutrix (Annexure P-7) has been recorded before the Additional Sessions Judge-cum-Judge, Special Court, Chandigarh on 23.05.2016 NARESH KUMAR 2016.07.18 12:08 I attest to the accuracy and integrity of this document Chandigarh
CRM-21023-2016 in/and -2CRM-M-12617-2016 whereby she has specifically stated that neither the petitioner had kidnapped her nor committed any wrong act with her. She has happilly at her in-laws house.
I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. Keeping in view the above-said statement of the prosecutrix (Annexure P-7), no useful purpose would be served to further detain the petitioner in jail. He was arrested on 29.01.2016. Since then, he is in judicial custody.
Therefore, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Chandigarh.
