  The present petition has been filed by the petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment an arbitrator to adjudicate upon the disputes between the parties. 2.

Vide order dated 12.01.2024 passed by this Court, Justice V.K.Gupta, former Chief Justice of Uttarakhand High Court, was appointed as arbitrator to adjudicate upon the disputes between the parties and necessary declaration as required under Section 12(5) of the Act of 1996 was called for and the same has been duly received.

In the absence of any compromise as such having been entered into between the parties, which fact was noticed in the last order dated 09.02.2024, the petition is allowed by confirming the earlier order dated 12.01.2024 passed by this Court. Accordingly, the order dated 12.01.2024 is made absolute. The learned Arbitrator shall proceed with the matter in accordance with law.
