(ORAL) Prayer in this petition is for issuance of a writ in the nature of habeas corpus to release the detenue namely, Rinki Kumari, who is alleged to be the wife of petitioner.
Learned counsel for the petitioner submits that the date of birth of Rinki Kumari is 10.01.1993 and she has passed her secondary school examination. Counsel submits that the marriage between the detenue and the petitioner took place on 30.12.2021 at Arya Samaj Mandir, Dadri, Gautam Budh Nagar, U.P. and, thereafter, respondent No.6 to 10 who are the parents/family members of the detenue have taken her back. CRWP-2056-2022 In pursuance to the notice of motion order, the learned counsel appearing for respondent No.4 as well as respondents No.6 to 8 and 10 who are the family members of the detnue, Rinki Kumari, who is present in Court submits that she is not interested in going with the petitioner Jaswant Lal and she wants to stay with her parents.
On a query from the detenue Rinki Kumari, she has stated at bar that she wants to stay with her parents.
In view of the same, it cannot be held that Rinki Kumari is in illegal detention of her family members.
