HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.501 dated 18.09.2021 under Sections 409,465,466,467,468,471,120-B IPC and Section 82 of Registration Act, 1908 registered at P.S Zirakpur, District SAS Nagar (Mohali).
FIR has been lodged on the complaint of Prakash Dogra, who stated that he had purchased a plot measuring 5 marla (125 sq feet) on 31.03.1998 from Smt Ratna Devi, resident of village Baltana, Tehsil Dera Bassi. At the time, when he purchased the plot, he had taken physical possession of the said plot and constructed boundary walls. The plot bore No.168. As the complainant did not possess sufficient money, he could not raise construction on the plot. However, later on, the complainant learnt that his five marla plot was divided in two portions and construction was being raised thereupon by two different occupants. He found his plot No.168 now being numbered as 143. The plot had been divided into two plots out of which one was numbered as 143 and the other half did not bear any number. It is alleged that one Simran Bedi, property dealer in Baltana had forged the revenue record in connivance with the revenue officials. CRM-M-11244 of 2022 (O&M) #2# took illegal possession of his plot and sold it to two persons by carving out two plots of 2 marlas and 3 marlas plot. The complainant has thereby been deprived of his property, value of which is at least Rs.35 lacs. Case of the petitioner is that his father had purchased the land in 1999 to the extent of 40/3520 share i.e 100 sq. yards. Again on 25.09.2020, he also purchased 21/3520 share i.e equal to 52.5 sq yds. His father was thus owner of plot measuring 152.5 sq. yards. The petitioner had inherited the land from his father.
The investigation in the case is stated to be complete and challan has been filed on 08.08.2022. The petitioner has been in custody since 04.11.2021.
Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is allowed. The petitioner Simran Singh is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
