(Oral) At this stage, in view of the objections regarding the maintainability of the petition, raised by the respondent in his reply, counsel appearing on behalf of the applicants submits that he does not want to pursue with the present application and makes prayer for dismissal of the same, with liberty to file afresh on the criminal side, to seek the same relief. He also undertakes to file such application, within a period of fifteen days, from today onwards.

Ordered accordingly.

However, at this stage, counsel for the respondent has given a statement that no precipitating steps shall be taken by the respondent, in the pending litigation, till filing of the petition, for seeking transfer of the petition under Section 12 of Protection of Women from Domestic Violence Act, by the applicant.

In the light of the aforesaid, the respondent shall remain bound by the statement, given by his counsel.
