**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that though he retired on 31.12.2018, but he has not been paid his pensionary benefits.

Though in the present writ petition, it has been mentioned that there is no valid justification with the respondents to withhold the pensionary benefits of the petitioner, but today another petition filed by the petitioner being CWP No.5305 of 2019 was also listed, wherein, he has challenged the various communications, which have been issued by the department for the recovery of certain amounts, which are pending against him due to non-deposit of the parts, which he was required to deposit while discharging his duties as Junior Engineer. CWP-5316-2019 -2writ petition, as to what is the total amount which is due to him on account of various orders passed by the respondents for the recovery, this Court is of the opinion that the case of the petitioner for the release of the pensionary benefits be considered by the respondents and the appropriate orders with regard to entitlement of the petitioner for the release of the pensionary benefits be passed within a period of two months from the date of receipt of certified copy of this order. Further, in case after passing of the order, it is found that certain benefits are liable to be released to the petitioner after his retirement on 31.12.2018, the same shall be released by the respondents within a period of one month thereafter.

It is, however, made clear that this Court express no opinion on the merits of the case or the entitlement of the petitioner in respect of the claim of pensionary benefits.
