BEDI, J (ORAL) This order will dispose of the above noted two petitions i.e., CRM-M-11802-2014 titled Major Singh Vs.Directorate of Intelligence Revenue and CRM-M-14640-2014 titled Gurcharan Singh Vs.Directorate of Intelligence Revenue, claiming that no recovery was effected from the petitioners but they have been involved in the case of recovery of 77.721 kgs. of heroin. Gurcharan
CRM-M-11802-2014 (O&M) Singh is a BSF employee whereas the petitioner Major Singh connived with the main accused in the act of supply of the contraband.
This is the third application for the grant of bail on behalf of Gurcharan Singh.
A report has been received that petitioner Gurcharan Singh has been in custody w.e.f. 9.4.2011 whereas petitioner Major Singh has been in custody w.e.f., 1.9.2012. A report regarding the duration in which the trial Court shall conclude the trial was called for. As per report dated 25.11.2014, the trial Court has sent an undertaking that the case will be decided within a period of six months after recording the entire evidence by giving short adjournments. The said period of six months if taken from 25.11.2014 expires on 25.5.2015. Both these petitions are disposed of with a direction to the trial Court that in case the trial is not concluded by above said date, the trial Court shall release the petitioners on bail on their furnishing bail bonds/surety bonds to its satisfaction.
