(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.400 dated 15.10.2017 under Sections 323, 325, 341, 506 and 34 IPC (Section 307 IPC added later on), registered at Police Station Hathin, District Palwal, Haryana. As per FIR, injured-Mustaq suffered serious head injury attracting offence under Section307 IPC. It was caused by co-accused Azad while assaulting the injured with a stone. Petitioner and the other accused gave fist blows and also caused injuries with stones. Petitioner is incarcerated since 19.11.2017. Investigation qua some of the accused is still pending. In view of the facts and circumstances of the case, no useful purpose would be served by detaining the petitioner any longer. Accordingly, petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Palwal.
