**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through videoconferencing. CRM No.34203 of 2021 For the reasons mentioned in the application, the same is allowed.

Main case Petitioners seek grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.189 dated 13.12.2020 registered under Sections 324, 323 and 34 IPC (Section 307

IPC added later on) at Police Station Kulgari, District Ferozepur. Notice of motion was issued on 12.03.2021 and arrest of the petitioners was also stayed.

Complainant was also impleaded as party respondent No.2. Complainant has prayed for vacation of interim stay. Vide order dated 27.08.2021, the petitioners were directed to appear before the Investigating Officer to join investigation.

Perusal of the record would show that gandasa blow attributed to Manjit Singh on the head of Jaswinder Singh was found to be not in dispute and injury was found to be dangerous to life. Injury attributed to petitioner No.1 i.e. kappa blow on the head of Jaswinder Singh was found to be simple in nature. The injury attributed to petitioner No.2 was also found to be simple in nature.

Learned counsel for the petitioner submits that in compliance of order dated 27.08.2021, petitioners have joined the investigation.

Learned State counsel on instructions from ASI Vinod Kumar submits that the petitioners have joined the investigation. Recoveries have already been effected and their presence is no more required for further investigation in the case. In view of aforesaid factual position, the interim order

dated 27.08.2021 s made absolute. Petitioners shall keep on joining the investigation as and when required to do so and they shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Petition stands disposed of.
