Mr. Ashok Paul Batra, Advocate for the petitioner. HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in case FIR No. 21 dated 15.03.2019 under Sections 61 & 78 of the Punjab Excise Act, 1914 registered at Police Station City-2 Abohar, District Fazilka. FIR was registered on the basis of secret information that certain persons namely Harjit Singh alias Billa, Paramjit Singh, Ajit Kumar @ Pappu and Daman were bringing liquor in a canter from Haryana, which was meant for sale in the State of Haryana only. A Naka was laid and an Indigo car was intercepted from which 4800 bottles of liquor were recovered. The occupants of the car managed to escape.

Learned counsel for the petitioner contends that the petitioner and co-accused Daman were granted interim anticipatory bail by the learned Additional Sessions Judge, Fazilka and directed to join investigation. The anticipatory bail of co-accused Daman was made absolute, however, the anticipatory bail of the petitioner was subsequently dismissed. It is submitted that the investigation in the case is complete and the challan has MANOJ KUMAR 2021.03.

Meanwhile, the petitioner may appear before the learned trial Court on or before the date fixed i.e. 07.04.2021. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect. Petition stands disposed of.
