Mr. Satnam Singh Gill, Advocate, for the petitioner. (Proceedings conducted through video conferencing) *** The petitioner seeks grant of interim bail on account of death of his father who is stated have expired on 3.3.2021 and whose last rites are to be performed on 14.3.2021.

Notice of motion.

On the asking of this Court, Mr. Prabhjot Singh Walia, AAG, Punjab accepts notice on behalf of respondent/State. Learned State counsel is requested to get the factum of death of petitioner's father verified, if conveniently possible today itself and also to seek report as to whether release of the petitioner is likely to create any problem.

(Oral) Pursuant to order passed today in the forenoon wherein learned State counsel was requested to get the factum of petitioner's father death verified, learned State counsel has informed that the aforesaid fact has been got verified through ASI Karamjit Singh and that it has been confirmed that the petitioner's father indeed expired on 3.3.2021 and that his last rites are to be performed on 14.3.2021.

Keeping in view the fact that a son would be required for performing the last rites of his father and while adopting a humane approach, the petition is accepted and the petitioner is ordered to be released on interim bail upto 16.3.2021 so as to enable him to participate in last rites of his

CRM-M-11580-2021 (O&M) - 2 - father, subject to his furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. It is directed that the petitioner, after availing interim bail, shall surrender before the jail authorities on the evening of 16.3.2021.
