ALKA SARIN, J. (ORAL) On 19.04.2022 the following order was passed : "Challenge in the present case is to the impugned order dated 10.05.2019 whereby the ex parte order dated 08.03.2018 had been set aside on the basis of a statement suffered by the counsel for the petitioner that he has no objection in allowing the said application, subject to heavy costs. The application was thereafter allowed subject to payment of Rs.1,000/- as costs. On 25.02.2020 none had put in appearance on behalf of the petitioner despite the matter being called twice. Yet again on 20.03.2020 none had appeared on behalf of the petitioner. Today again none has put in appearance on behalf of the petitioner despite the matter being called twice.

CR-1294-2020 (O&M) -2Keeping in view the fact that the matter has been taken up for the first time after 20.03.2020 due to the intervening circumstances created because of Covid-19 Pandemic, last opportunity is granted to learned counsel for the petitioner to argue the matter, failing which, the present petition shall be dismissed for nonprosecution. Adjourned to 30.05.2022.

Today the matter has been called thrice. No one has put in appearance on behalf of the petitioner. It appears that the petitioner is not interested in pursuing the present petition. This Court is left with no other option but to dismiss the present petition for non-prosecution. Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
