This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 75 dated 10.04.2007 under Sections 323, 452, 506, 120-B, 148 & 149 IPC at Police Station Phillaur, district Jalandhar. Learned counsel for the petitioner submits that petitioner could not appear before the trial court as he had to go abroad. Co-accused have been acquitted. Thus, petitioner is entitled to concession of pre-arrest bail.

Prayer has been opposed by learned State counsel. I have heard learned counsel for the parties. Case was registered on complaint of Harpreet Singh who alleged that on 10.04.2007 at about 10.00 P.M., petitioner alongwith other accused entered his house and inflicted injuries. After the occurrence, all of them fled from the scene.
