The petitioner is alleged to have filled in the amount of Rs.49 lacs in the cheque, alleged to have been issued by UP Warehousing Corporation. The said amount has been fraudulently withdrawn by coaccused Mann Singh and had transferred part of the amount in different accounts. Name of the petitioner was allegedly disclosed by main accused Mann Singh. It will be debatable during trial whether on the basis of the statement of co-accused and there being no report of expert, conviction would be warranted with the aid of Section 113 and illustration (b) of Section 114 of Indian Evidence Act.
Without expression of any opinion on merits of the case, taking into consideration the fact that the petitioner has been in custody since 6.8.2014, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
