Learned counsel for the University contends that the matter has been rendered infructuous, since the petitioner superannuated from service on 30.4.2008, and the third respondent against whom he has raised the claim of seniority, sought voluntary retirement from service w.e.f.23.1.2006.

Learned counsel for the petitioner seeks a short accommodation to get instructions whether the petitioner is interested in pursuing the matter.
