SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.12 dated 15.01.2020 registered under Sections 420, 406 of Indian Penal Code, 1860 at Police Station City Batala, District Batala. On 25.02.2020, this Court passed the following order:- "It is submitted that the petitioner stood as a guarantee for his brother Hardev Singh who had assured the complainant that his son will be sent to England and for this purpose, the complainant had paid a sum of `4.00 lakhs. According to counsel, further allegation against the petitioner is that an amount of `4.00 lakhs was returned by way of two cheques viz SAVITA KADIAN 2021.07.14 15:44 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-8030 of 2020 {2} `2.00 lakhs each by Hardev Singh in the presence of the petitioner.

Notice of motion for 21.04.2020.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, he shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. He shall also abide by the conditions as specified under Section 438(2) Cr.P.C."

Learned State counsel, on instructions from SI Sarwan Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation. He has further instructions to submit that no other case is pending against the petitioner. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 25.02.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
