**** JAISHREE THAKUR, J. (ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 23 dated 01.03.2017 under Sections 498-A and 406 IPC, registered at Police Station Sadar, Phagwara, District Kapurthala.

This Court was pleased to pass the following order on 07.04.2017 :- "Learned counsel for the petitioner states that the petitioner is working as Lab Attendant. He is earning about Rs.8000/- per month by doing the said work. Learned counsel further states that the petitioner is ready to amicably settle the dispute with his wife.

On an oral request, complainant-Jashanpreet Kaur @ Sonia is impleaded as respondent No.2 in this petition. Subject to deposit of Rs.30,000/- before the Registry of this Court towards litigation expenses, notice of motion be issued for 06.07.2017.

CRM-M-11929-2017 -2investigation as and when called by the Investigating Officer. In the event of his arrest, he shall be released on bail by the Investigating Officer on his furnishing bail bonds/sureties to his satisfaction, subject to the following conditions, as envisaged under Section 438(2) Cr.P.C:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; (iii) that the petitioner shall not leave India without the previous permission of the Court.

(iv) such other condition as may be imposed under sub section

(3) of Section 437, as if the bail were granted under that section."

Learned counsel for the petitioner submits that the petitioner has joined the investigation.

Learned counsel for the respondent-State confirms the factum of joining investigation by the petitioner.

Since the petitioner has joined the investigation, the petition is allowed and interim order dated 07.04.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 08.02.2018 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
