The petitioner has been in custody since 10.9.2015 for having been found in possession of 60 kgs of poppy husk, which is marginally higher than the commercial quantity prescribed. It appears that the petitioner is involved in another case of recovery of non commercial quantity of poppy husk. Adopting the reformatory approach with a sanguine hope that the period of detention suffered by the petitioner will have a deterrent effect upon the petitioner not to commit the similar offence again, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that in case the petitioner is found indulged in similar activity, his bail will be liable to be cancelled forthwith without any notice to the petitioner.
