R.P. Nagrath, J. (Oral) Prayer in the instant petition is made under Section 439 Cr.P.C. for grant of regular bail in FIR No. 04 dated 04.01.2015 for offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, registered at Police Station City Tarn Taran, District Tarn Taran.
Learned State counsel on instructions from ASI Kulwinder Singh submits that FSL report has been received and the report is negative and does not support the version about the salt to be offending the provisions of NDPS Act. It is otherwise submitted by learned State counsel that an application was moved on 21.08.2015 before the Judge, Special Court for sending second sample to FSL.
Be that as it may, there is no useful purpose to keep the petitioner in custody anymore. The petitioner is in custody since 04.01.2015 and it will take time in conclusion of the trial. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
