Prayer in the petition under Article 226/227 of the Constitution of India is for issuance of a writ in the nature of Mandamus directing the respondents to scrutinize the documents of the petitioner and declare him as eligible, as the petitioner has scored more marks than the last selected candidate in the EWS Category.
Learned counsel for the petitioner submits that the petitioner had applied for the post of Store Keeper in terms of the Advt. No.12/2019 dated 20.07.2019 (Annexure P-1), being eligible, in Economic Weaker Sections (EWS) Category; that the written examination was conducted on 20.02.2020 and the petitioner cleared the written examination; that the successful candidates in written examination were directed to upload their documents for online scrutiny; that as the petitioner belongs to a rural area and is not conversant with latest technology, moreover, his father was also not well, MANGAL SINGH 2023.03.23 18:50 I attest to the accuracy and authenticity of this order/judgment.
therefore, he could not upload the documents for online scrutiny and that nonuploading of documents is not intentional. In support of his case, he relies upon the judgment passed by a Division Bench in LPA-385-2017 titled as 'Kiran Bala Vs. State of Haryana and Others', !
