Present petition under Section 439(2) Cr.P.C. for cancellation of bail granted to respondent No.2-Jagjit Singh. Relevant facts of the case that regular bail application of respondent No.2-Jagjit Singh was accepted by this Court vide order dated 12.10.2015 while taking into consideration the fact that petitioner was in custody since 31.3.2015 and conclusion of the trial of the case was still to take some more time.

Learned counsel for the petitioner submitted that there were certain call details and the said incriminating evidence should have been considered by the Court and bail should have not been granted to DEEPAK KUMAR BHARDWAJ 2016.01.20 17:17 I attest to the accuracy and integrity of this document

Having considered the submissions made by learned counsel for the petitioner, this Court is of the considered view that main accused Baljinder Singh, who had allegedly fired on Manoj Kanjla (since deceased) had already been arrested and the weapon, used for commission of offence in the case, was recovered and considering all the available facts, there is absolutely no ground for cancellation of bail. In view of above, present petition is without any merit and the same stands dismissed, in limine.
