R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of anticipatory bail under Section 438 Cr.P.C. in FIR No. 12 dated 12.03.2015 for offences under Sections 307, 341, 427, 382, 323 and 34 of Indian Penal Code (IPC), registered at Police Station Sherpur, District Sangrur.
The allegation against the petitioner is that he exhorted his companions and was armed with baseball bat but he has not been attributed any injury.
Learned State counsel on instructions from ASI Major Singh submits that the petitioner has joined the investigation and is stated to be no more required for further investigation. In view of the above and without commenting on merits of the case, the interim order dated 10.04.2015 is made absolute. Petitioner shall also abide by the restrictions contained in Section 438 (2) Cr.P.C.
Allowed in the above terms.
