Versus

State of Haryana .....Respondent

CORAM:

HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL

Present:

Mr. B.S. Beniwal, Advocate for the petitioner.

Mr. Yuvraj Shandilya, Assistant Advocate General, Haryana. MANJARI NEHRU KAUL , J. (ORAL) This order shall dispose of the above-mentioned petitions filed by the petitioner for grant of interim bail.

2.

Mr. Siddharth Sharma, Advocate, has entered appearance on behalf of the complainant and filed his power of attorney, which is taken on record.

3.

In CRM-M-8560-2025, the petitioner is seeking the concession of interim bail in FIR No.13 dated 10.01.2023 under Sections 307 of the IPC and Section 25 of the Arms Act, registered at Police Station Kurukshetra University, District Kurukshetra, and in CRM-M-8592-2025,

CRM-M Nos.8560 and 8592 of 2025 the petitioner is seeking interim bail in FIR No.9 dated 10.01.2023 under Sections 302, 323, 460, 396, 397, 120-B of the IPC and Sections 25 of the Arms Act, registered at Police Station City Thanesar, District Kurukshetra, on account of marriage of his brother, which is to be solemnized today i.e. 15.02.2025 at Community Centre, Sector 27, Panchkula, Haryana.

4.

In compliance of order dated 14.02.2025 passed by this Court, Status report by way of affidavit of Deputy Superintendent of Police, hq, Kurukshetra, on behalf of respondent-State has been filed in the Court today, which is taken on record subject to all just exceptions. 5.

Learned counsel appearing for the State along with counsel for the complainant have vehemently opposed the prayer and submissions made by the counsel opposite for extending the concession of interim bail to the petitioner in view of not only his criminal antecedents but also on account of the fact that there is a reasonable and genuine apprehension that he could misuse even the concession of interim bail by threatening the witnesses, more so when the case is fixed for prosecution evidence. However, while drawing the attention of this Court to the status report filed, learned State counsel submits that marriage of the brother of the petitioner is indeed to be solemnized today at Community Center, Sector 27, Panchkula. 6.

I have heard learned counsel for the parties. 7.

In view of the antecedents of the petitioner and the stage of trial, this Court is not inclined to accept the prayer of the petitioner for grant of interim bail for two days. However, he is allowed to attend the marriage of his brother only for one day i.e. on 15.02.2024 in police

CRM-M Nos.8560 and 8592 of 2025 custody. The petitioner shall be taken under police cusotdy to the venue of the wedding i.e. Community Center, Sector 27, Panchkula, today at 01:00 PM and would be escorted back to the Jail, where he is presently lodged on the same day by 04:30 P.M. All travel expenses incurred by the authorities concerned, shall be borne by the petitioner. 8.
