The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.422 dated 1.7.2012 registered for the offences under Sections 148, 149, 323 and 506 IPC at Police Station City Bhiwani, District Bhiwani. Notice of motion to Advocate General, Haryana. On the asking of the Court, Mr. Deepak Grewal, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State, accepted notice and contested this petition. Police record is also available.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Haryana appearing for the respondent-State HARPAL SINGH PARMAR 2015.01.21 16:16 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-1202 of 2015 [2] and have gone through the record.

The main offence is under Section 323 IPC, which is bailable. The other offences are under Sections 148, 149 and 506 IPC. The petitioner is stated to be in custody since 18.10.2013. The offences are triable by Judicial Magistrate Ist Class. The petitioner is not required for interrogation and investigation purposes as he is in judicial custody. Nothing is to be recovered from him. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate. January 20, 2015.
