The petitioner is an accused in FIR No.21 dated 08.03.2017, under Sections 304B/34 IPC registered at Police Station Lohian, District Jalandhar Rural.
This petition has been filed seeking direction to respondents No.2 and 3 to conduct a fair and impartial inquiry in the abovesaid FIR. It is not disputed that the investigation in the abovesaid FIR is being carried on at this stage. The petitioner is admittedly not on bail. During the course of arguments, learned counsel for the petitioner submits that he restricts his prayer for protection of petitioner's property and to prevent destruction of standing crops at the hands of the complainant party. It is fairly stated by learned counsel for the petitioner that no such averment in Omkar Singh 2017.04.18 12:43 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-12105 of 2017 [2] regard to any threat regarding his property or standing crops has been brought before the concerned authorities.
Keeping in view of the facts and circumstances, I do not find any ground to interfere in exercise of jurisdiction under Section 482 Cr.P.C. at this stage.
Dismissed.
The petitioner is however at liberty to avail remedies which may be available to him.
