(ORAL) Present writ petition has been filed for directing the official respondents to immediately restrain respondent No.5 (Chairman, M.C., Dabwali) from shifting the present M.C. office i.e. Old Civil Hospital Building and from closing/demolishing the road between Old Court and Old Civil Hospital as has been resolved by the General House of M.C. on 18.12.2023 (Annexure P-5). Further prayer has been made for directing the official respondents to conduct enquiry against respondent No.5 for willfully violating the resolution dated 18.12.2023 passed by the M.C. house (Annexure P-5) without any legal basis at all. CWP No.4402 of 2024 -2- 2024:PHHC:033905 After the issuance of notice of motion, the State has filed the status report dated 11.03.2024 by Surender Kumar Executive Officer, Municipal Council Mandi, Dabwali (Sirsa) on behalf of respondents No.1 to 3 and 5.

Learned counsel appearing on behalf of the respondentMunicipal Committee has submitted that the resolution was passed by the Municipal Committee in due process of law on 18.12.2023 and the same has been cancelled by the District Municipal Commissioner, Sirsa on 08.03.2024. He has submitted that if the petitioners have any grievance regarding the new order dated 08.03.2024 then they have the remedy to further assail the same as per provisions of Haryana Municipal Act. In view of the above position, the present petition is disposed of with liberty to the petitioners to assail the order dated 08.03.2024 in accordance with law, if they are aggrieved of the same.
