Dated Police Station Sections 01.09.2021 Ajnala, District Amritsar Rural 302, 323, 324, 427, 148, 149 IPC The petitioner apprehending arrest in the FIR captioned above, on the allegations of attacking the complainant party with common object of taking revenge on breaking of engagement of one of their relatives, assaulted them, which led to death of one injured, had come up before this Court under Section 438 CrPC seeking anticipatory bail.
Vide order dated 20-04-2022, the petitioner was granted interim protection, which is continuing till date. There were allegations of intimidation during bail, but those were not substantiated. In FIR, petitioner was not attributed any injury. Given the above, there would be no justification to discontinue the interim protection, and the same is made absolute subject to the petitioner complying with the terms of the bail order. It is clarified that in case the petitioner violates even a single condition of bail, the complainant and/or State may file an application(s) for bail's cancellation. Petition allowed in aforesaid terms. Interim order dated 20.04.2022 is made absolute subject to strict compliance of all terms and conditions. All pending applications, if any, stand disposed.
