(ORAL) The petitioner has filed the instant petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing FIR No.189 dated 09.07.2021, under Sections 379-B and 307 of the Indian Penal Code (Section 307 IPC added later on and Section 285 IPC deleted) and under Sectiion 25 of the arms Act, registered at Police Station Mundkati, District Palwal.

CRM-M-10446-2022 inter alia contends that though there is a written request circulated on behalf of the learned counsel for the petitioner, however, pursuant to the order dated 05.04.2022 passed by this Court, the petitioner has joined investigation and is no longer required for investigation of the case. Learned State counsel on instruction from ASI Kushal Kumar, corroborates the said averment and submits that the custodial interrogation of the petitioner is not required for the purpose of investigation.

Heard learned counsel for the parties.

Since the petitioner has joined the investigation and his custodial interrogation is not required, the present petition is allowed and the interim order dated 05.04.2022 is made absolute. However, the petitioner shall continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 438 (2) Cr.P.C. August 10, 2022.
