(ORAL) The appellant has come up in appeal against the judgement and order dated 26.02.2021 passed by the learned Single Judge, whereby the writ petition filed by the petitioner (appellant herein) was disposed of relegating him to alternative remedy.

Learned State counsel seeks more time to verify the Dependency Certificate of Ex-Serviceman (Annexure P-15).

The certificate (Annexure P-15) has been issued by the District Sainik and Ardh Sainik Welfare Office, Charkhi Dadri. The respondents can verify the validity of the certificate (Annexure P-15) which has been issued in February, 2020 and thereafter proceed to give appointment to the appellant. The writ petition filed by the petitioner was disposed of by the learned Single Judge on the ground that the date mentioned in the eligibility certificate was 24.07.2002 and the validity of the certificate was only one year as per clause 7 thereof. Since there is no doubt that the appellant is the dependent of exserviceman, as per the certificate (Annexure P-15), the impugned order passed by the learned Single Judge is set aside and the appeal stands allowed.

The respondent-authorities are directed to issue appointment letter to the appellant on the post of TGT (Science) keeping in view the fact that three posts out of ten are lying vacant under the ex-serviceman category after the selection process was completed as mentioned in paragraph 31 of the writ petition and this fact was not disputed in the written statement and even as per the final result (Annexure P-7) at page 65 of the paper book out of ten posts AMODH SHARMA 2024.01.

LPA-277-2021 (O&M) 2023:PHHC: 009790-DB -2three posts are still vacant. It is further directed that the appellant shall be given appointment with notional benefits.

The entire exercise be completed by the respondent-authorities within two weeks and this Court be informed accordingly.
