After hearing counsel for the parties it appears that the liability of Rs. 4.00 lacs is alleged against petitioner Gurpreet Singh. A perusal of the police record indicates that a sum of Rs.2.50 lacs has been received by complainant Simarjit Kaur from the petitioner after the registration of the case. Copy of the receipt dated 8.10.2015 has been placed on record.
In view of the part of the alleged liability having been discharged by the petitioner without prejudice to his rights; the case being civil as well as criminal liability; the petitioner having joined the investigation, he can be granted the concession of pre-arrest bail. The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
