The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 172 dated 15.09.2023 under Sections 21, 29 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City Fazilka, District Fazilka.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR and the recovery was effected from his wife and other two persons who nominated the petitioner. 3.

Learned State counsel has pointed out that the petitioner is a habitual offender and there are five more cases pending against the petitioner out of which 04 cases are under NDPS Act and 01 is under IPC and submits that the petitioner is on bail in those FIRs but still committed an offence of similar nature and the authorities are in process to apply for PARUL 2024.05.06 18:04 I attest to the accuracy and authenticity of this document cancellation of bail in those cases also.

After hearing learned counsel for the petitioner at length, I do not find any merit in the present petition for the reason that wife named the husband, who is a habitual offender and has bad antecedents. 5.

Accordingly, the present petition stands dismissed. 6.

Pending miscellaneous application, if any, also stands disposed of.
