CRM No.M-122 of 2017 Learned counsel for the petitioner submits that FIR No.56 dated 09.09.2016 was initially registered under Sections 302/34 IPC against the petitioner and a co-accused. After investigation of the matter, the petitioner and the co-accused were proceeded against for the offences punishable under Omkar Singh 2017.04.18 12:43 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-122 of 2017(O&M) [2] Sections 306/506/34 IPC, Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Section 3(2) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Mr. S.K.Khurcha, Advocate appears on behalf of the complainant and files his power of attorney. The same is taken on record subject to just exceptions. It is submitted that the complainant has no objection to the grant of bail pending trial to the petitioner in this case. The petitioner is aggrieved of the order dated 17.12.2016 whereby the learned trial court has dismissed the petitioner's application under Section 167(2)(a)(I) Cr.P.C. A perusal of the abovesaid order of the learned trial court reveals that it has been passed on an application under Section 167(2) Cr.P.C. Learned counsel for the petitioner, thus, seeks to withdraw this petition with liberty to approach the learned trial court for the concession of bail pending trial.
