*** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.148 dated 13.04.2018, registered under Sections 186, 323, 332, 34, 353, 451, 506 (Section 3(1) of Prevention of Violence of Damage of Property Act, 2009 added later on) (Section 451 IPC deleted later on) at Police Station Civil Lines Gurgaon, District Gurugram (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise and affidavit dated 16.02.2019 (P-2 (colly). Pursuant to order dated 25.02.2019 of this Court, the parties appeared before the trial Court on 11.03.2019 along with receipt of `15,000/- to get their statements recorded. Learned Addl. Chief Judicial Magistrate, Gurugram, has submitted his report vide letter bearing No.43 SONIKA 2019.04.05 16:33 I attest to the accuracy and authenticity of this document Chandigarh dated 26.03.2019 duly forwarded by learned District and Sessions Judge,
CRM-M-8548 of 2019 --2-- Gurugram, vide letter bearing No.758/C-29 dated 28.03.2019. According to the report, ld. Addl. Chief Judicial Magistrate, Gurugram, is satisfied that the matter has been voluntarily compromised between the accused persons and complainant, out of their own volition and same is without any pressure or coercion. No accused has been declared as proclaimed offender.
Considering the report of ld. Addl. Chief Judicial Magistrate, Gurugram, dated 26.03.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.148 dated 13.04.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
