M.M.S. BEDI, J (ORAL) Counsel for the petitioner submits that the petitioner is unmarried sister-in-law of the complainant whose husband has gone to Australia. It is contended that there are allegations of demand of dowry against the father-in-law and mother-in-law. So far as the petitioner is concerned, it is claimed that there are vague and uncertain allegations against the petitioner as per the FIR of having taunted the complainant for bringing less dowry. No day, date and time has been mentioned regarding the petitioner along with her parents having caught hold of the complainant or having assaulted her. The main allegations of having illicit relations with another lady are against the husband of the complainant.

All the pleas which have been raised before this Court can be raised at the time of consideration of charges. It will always be open to the trial Court to go through the entire challan and form an opinion that allegations against the petitioner are vague and uncertain not warranting framing of charges along with other coaccused. This petition is disposed of as pre mature with liberty to the petitioner to raise all the pleas before the trial Court. In case the pleas are raised, the trial Court will pass a speaking order taking into consideration the material forming part of report under Section 173 (2) Cr.P.C. and the pleas raised by the petitioner.
