IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 6731 of 2022 Date of Decision:- 31.03.2022 Mrs.Mamta ....Petitioner vs.

State of Haryana and others ....Respondents *** BEFORE :- HON'BLE MR. JUSTICE SUDHIR MITTAL *** Present:- Mr. Rajesh Kumar Kadian, Advocate, for the petitioner.

*** Sudhir Mittal, J. (Oral) The petitioner has approached this Court because allegedly her son was sexually assaulted resulting in registration of an FIR. On the complaint of the petitioner to take action against the school concerned, an enquiry has been conducted but the school has been exonerated from any wrong doing. Learned counsel for the petitioner has submitted that exoneration of the school is illegal. This submission is based upon transfer certificate Annexure P-5 which has been issued for promotion to Class VI whereas actually the son of the petitioner has passed Class VI as is evident from Annexure P-3. The argument is misconceived. Just because an erroneous transfer certificate has been issued, it would not imply that the exoneration of the school was illegal or improper.

If the petitioner is aggrieved by the issuance of an erroneous transfer certificate, she can always apply for correction thereof and the school authorities would be bound to correct the same.

Finally, it has been submitted that directions be issued to the official authorities to ensure that a similar incident does not occur ever again. POONAM RATHORE 2022.04.01 15:49 I attest to the accuracy and integrity of this document

CWP No. 6731 of 2022 -2Such omnibus directions cannot be issued as crime cannot be prevented by issuing directions to the State. Thus, this prayer is also rejected. No other point has been argued or raised.

The writ petition has no merit and is dismissed accordingly. March 31, 2022 ( SUDHIR MITTAL ) poonam JUDGE Whether Speaking/Reasoned Yes Whether Reportable No POONAM RATHORE 2022.04.01 15:49 I attest to the accuracy and integrity of this document
